RE: AB 2167
(De Leon)
I am pleased to be able to provide some good news even in
these horrible budget times. Yesterday, Governor
Schwarzenegger vetoed AB 2167 (De Leon). As you will
recall, AB 2167 would have allowed classified employees to
challenge any item in their personnel files if they believed
the item was false, harassing, frivolous, or without merit.
The district's grievance procedure would be used to
determine whether an item would be removed or not.
The Governor's veto message stated "Current law already
provides adequate protection for school employees to review
the contents and provide rebuttal to documents in their
personnel file. Enacting this bill could result in
hindering the reasonable process of school management
personnel to fairly evaluate and discipline employees. For
these reasons, I am unable to sign this bill."
My sincere thanks to all of you who wrote letters, made
phone calls, and helped in securing the veto of this
legislation.
